Brennan Pendley, a former ColumbiaElementary School aide convicted
last summer of having sex with a student in a classroom, will not be
included in the publicly available Megan's Law database of sex
offenders, according to law enforcement officials.
Don Meyer, Sacramento County's chief probation officer, said
Pendleyis required to register as a sex offender with law enforcement
but that his information won't be postedon the Internet, alongside
hundreds of other offenders.
"He's what's considered a no-post, which means he has to
register...but it's not public," Meyer said.
Pendley, 25, pleaded guilty in July 2011 in Tuolumne County Superior
Court to two felony counts of having unlawful sex with a minor and one
count of sending harmful matter to seduce a minor.
In exchange for the guilty plea, a third charge of unlawful sex with a
minor and an additional child-molestation charge were both dropped.
The charge of sending harmful matter was changed from a felony to a
misdemeanor.
A spokesman for the California Attorney General's Office said one of
the original charges against Pendley, a misdemeanor child molestation
charge, would have required the publication of his zip code — but not
home address — onthe Megan's Law database.
Pendley's attorney, Mark Borden, said in July 2011 that he pleaded
guilty to reduce his exposure to a possibly tougher sentence.
More recently, he told the Union Democrat that being excluded from
Megan's Law was not a factor in the plea deal.
"The plea bargain was straight up 'what you see is what you get' on
the court file," Borden said.
He declined to comment on the specifics of Pendley's case and their
bearing on Megan's Law requirements.

Blaze claims Mountain Springsarea home

Firefighters responded to a residential structure fire in the 1300
block of Kincaid Flat Road near the Mountain Springs golf course at
about 11:40 this morning.
A spokeswoman for Cal Fire said the home was fully immersed in flames
when firefighters arrived on scene. The fire spread into nearby
vegetation and has burned less thana quarter of an acre.
There are no other homes or structures threatened, according toCal Fire.
As of 2:00 this afternoon, firefighters are still on scene. A total of
10 fire engines and three water tenders responded. The responding
agencies were Cal Fire, the Sonora Fire Department and the Jamestown
Fire Department.
